Data Processing Addendum
Data processing terms for BuildPod OS customers where BuildPod LLC processes personal information on behalf of a customer.
Parties and roles
Where privacy law concepts apply, the customer may act as controller/business for customer data and BuildPod LLC may act as processor/service provider for personal information processed on the customer’s behalf. Roles may vary based on the data and legal context.
Processing instructions and purpose
BuildPod LLC processes customer data according to customer instructions, applicable agreements, product configuration, support requests, migration/import instructions, and documented operational needs to provide, secure, support, and improve BuildPod OS.
Nature, categories, and data subjects
- Nature and purpose: hosting, storage, organization, support, migration, import, analytics, security, and operation of BuildPod OS.
- Categories of data: account, contact, company/workspace, job, operations, staging, inventory, workforce, asset, maintenance, proof, files, photos, uploads, logs, and support data.
- Data subjects: customer personnel, workers, invited users, subcontractors, vendors, customer contacts, and other individuals whose information is entered by the customer.
Confidentiality and security measures
BuildPod LLC will require personnel with access to customer data to protect it appropriately and will use reasonable technical and organizational measures designed to protect customer data based on the nature of the service.
Subprocessors
BuildPod LLC may use subprocessors to provide hosting, infrastructure, payment processing, email, support, business operations, AI features, or other enabled services. Subprocessor use may vary by environment and enabled features.
Assistance, breach notification, return, and deletion
BuildPod LLC will provide reasonable assistance with data subject requests, security inquiries, and deletion/export requests where technically and contractually feasible. BuildPod LLC will notify customers of confirmed security incidents affecting customer data as required by applicable law or agreement. Return or deletion of data is subject to technical, legal, backup, and retention limits.
Cross-border transfers and audit process
Processing may occur in the United States or other locations where providers operate. Cross-border transfer requirements, audit/assessment processes, and additional terms may be addressed in a separate written agreement where applicable.
Conflict with main terms
If this Data Processing Addendum conflicts with the Terms of Service for processing of customer personal information, this Addendum controls for that specific processing issue unless a separate signed agreement states otherwise.
